General Terms

These Terms of Service ("Terms") govern your use of portrait photography services ("Service") provided by TATSUO SUZUKI ("Photographer"). By booking the Service, you agree to be bound by these Terms.

1. Booking & Contract

A booking is confirmed upon completion of payment through the Photographer's designated payment method.

2. Payment & Currency

Full payment is required in advance via credit card. All prices are listed in Euros (€). The actual charge to your account may vary due to your card issuer's exchange rate and fees. The Photographer accepts no responsibility for any currency conversion differences.

3. Minors

Clients under 18 years of age must be accompanied by a parent or guardian, or provide prior written parental consent. The Photographer accepts no liability for sessions involving minors booked without such consent.

4. Photo Delivery

Delivery terms are as follows:

  • Estimated delivery: within 7–14 business days after the session

  • Number of photos: as specified in your selected plan

  • Photo selection: made at the Photographer's discretion

  • For plans including a print, shipping time varies by destination country

5. Editing & Retouching

Individual editing or retouching requests are not accepted. All photos are edited according to the Photographer's artistic style. Please ensure you are comfortable with this style before booking.

6. Late Arrival & No-Show

If you arrive late, the session will not be extended beyond the originally scheduled end time. If you fail to appear at the meeting point at the agreed time without prior notice, it will be treated as a no-show cancellation and no refund will be issued.

7. Copyright & Ownership

All photographs taken during the session are the exclusive intellectual property of TATSUO SUZUKI. Payment for the Service does not constitute a transfer of copyright.

The Photographer may use the images for portfolio, website, social media, exhibitions, and publications. If you do not wish your photos to be published, please notify the Photographer before the session. Requests made after the session cannot be accommodated.

8. Permitted Use by Client

You are granted a non-exclusive license to use the delivered photos for personal use and social media posts.

Commercial use (advertising, sales, corporate purposes, etc.) requires prior written permission from the Photographer and may be subject to an additional licensing fee.

The following uses are strictly prohibited: reselling or transferring photos to third parties, use as AI training data, minting as NFTs, and unauthorized redistribution.

9. Prohibited Conduct

You must not:

  • Violate any laws or public order

  • Infringe upon the rights of the Photographer or any third party

  • Request dangerous poses or shooting situations

  • Interfere with the Photographer's work

  • Use photos for AI training, unauthorized resale, or redistribution

  • Engage in any conduct deemed inappropriate by the Photographer

10. Limitation of Liability

The Photographer shall not be liable for inability to provide the Service due to:

  • Weather conditions, natural disasters, or social circumstances

  • Delays or cancellations of public transportation

  • Equipment failure due to force majeure

  • Restrictions or regulations at the shooting location

This limitation does not apply in cases of the Photographer's willful misconduct or gross negligence.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of Japan. Any disputes arising from the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court.

Copyright & Photo Usage Policy

1. Copyright Ownership

All photographs taken during sessions with TATSUO SUZUKI ("Photographer") remain the exclusive intellectual property of the Photographer. Payment for a session does not constitute a transfer of copyright.

2. Permitted Use by Client

The Photographer grants you a non-exclusive, non-transferable license to use the delivered photographs for the following purposes:

  • Personal use (printing, saving, viewing, etc.)

  • Posting on personal social media accounts and personal blogs

Credit: While not required, crediting © Tatsuo Suzuki is greatly appreciated.

3. Commercial Use

Prior written permission from the Photographer is required for any of the following uses:

  • Advertising and promotional materials (digital or print)

  • Publication in magazines, books, or media

  • Use on brand or corporate social media accounts

  • Sales promotion for products or services

4. Prohibited Uses

The following are strictly prohibited:

  • Selling, transferring, or redistributing photos to third parties

  • Using photos as AI training data

  • Minting or selling photos as NFTs

  • Unauthorized alteration or manipulation of photos (minor filters excepted)

  • Using photos in a manner that damages the Photographer's reputation

5. Photographer's Right to Use Images

The Photographer reserves the right to use session photographs for the following purposes:

  • Portfolio and website display

  • Social media posts (Instagram, etc.)

  • Exhibitions and publications

  • Promotional and marketing materials

If you do not wish your photos to be published, please inform the Photographer before the session begins. Requests to remove already-published photos cannot be guaranteed.

6. Model Release & Portrait Rights

By participating in a session, you grant the Photographer the right to use your likeness as described in Section 5 above.

Third parties who inadvertently appear in the background of photographs will be handled with reasonable care by the Photographer.
